GoMaybeApp Terms of Use
Version 1.4. Effective October 26, 2026. Applies to GoMaybe on iPhone, including Duo.
These are the app terms, not the separate website or launch reminder terms. The agreement includes arbitration and related restrictions where lawful, with exceptions and a 30 day opt out. Mandatory legal rights remain.
Private beta notice: email entry checks the invited list without verifying mailbox ownership. Participation requires the separate beta notice and agreement. In an enabled beta build, reports send original JAXtraction suggestions and saved event details to Reyes and Rivera LLC for review by Job Rivera. Reporting requires a separate participation notice and agreement before it begins. See the App Privacy Policy for details. This notice does not change the agreement below or itself authorize data collection.

United States. Apple App Store
Application Provider: Reyes and Rivera LLC
Version: 1.4
Effective Date: October 26, 2026
IMPORTANT: Section 22 contains an individual arbitration agreement, restrictions on class proceedings, and a jury-trial waiver where lawful, with exceptions and a 30-day arbitration opt-out.

1. ACCEPTANCE; ELIGIBILITY; PARTIES; IMPORTANT DISPUTE NOTICE
PLEASE READ THIS AGREEMENT CAREFULLY. SECTION 22 PROVIDES FOR INDIVIDUAL ARBITRATION AND LIMITS CLASS PROCEEDINGS AND, WHERE LAWFUL, JURY TRIALS. IT INCLUDES IMPORTANT EXCEPTIONS AND A 30-DAY RIGHT TO OPT OUT.
This End User License Agreement ("EULA" or "Agreement") is between you ("you" or "User") and Reyes and Rivera LLC, a California limited liability company ("Company," "we," "us," or "our"), concerning the GoMaybe mobile application and related software, functionality and Company content made available with it (collectively, "GoMaybe" or the "Licensed Application"). Apple Inc. ("Apple") is not a party to this EULA.
You accept this EULA by selecting Agree and Continue after these terms are presented, or by another legally sufficient affirmative acceptance expressly associated with these terms. If you do not agree, do not accept or use the Licensed Application. This control does not verify a user's age, legal capacity or a parent's identity or consent.
An acceptance mechanism may record the terms version, app version and acceptance event on your device. This provision does not authorize remote tracking, collection of unrelated information, or a GoMaybe online account. Any additional handling of acceptance or legal-notice information must be accurately disclosed and comply with applicable law. Where law requires a different or additional form of consent, Company will use that form.
Eligibility
GoMaybe is a general audience planning app offered for the United States release without a minimum age declaration. If you are a minor, your parent or legal guardian should review these terms with you and approve or supervise your use where applicable law requires. A parent or guardian accepting on a child's behalf must have authority to do so. No provision assumes that a minor can make an enforceable contract or waive a mandatory right merely by tapping a button. Applicable law controls legal capacity, guardian approval and any limits on these terms.
GoMaybe does not request a birth date or identity document in this onboarding. Event organizers, venues and ticket providers set their own age and admission requirements. Saving an event or ticket does not establish eligibility to attend. The app's audience is separate from Apple's assigned age rating and does not override device or parental controls.
Public corrections and separate beta arrangements
In the public version covered by this EULA, correcting imported event details does not automatically send the corrections, source images, Calendar data, tickets or planner library to Company. Explicitly remembered corrections remain on the user's device and are not used to train a shared model. A separately invited testing beta may have different participation terms and privacy disclosures. Beta collection authority does not authorize public collection or collection from children. Any future public collection requires an accurately disclosed and lawfully implemented change before activation.
Organizations
If you use GoMaybe on behalf of a business or other organization, you represent that you have authority to bind it to this EULA, and "you" includes that organization where applicable. Organizational use remains subject to the applicable Apple Usage Rules.
Company obligations
The obligations under this EULA are obligations of Company. To the maximum extent permitted by applicable law, no member, manager, officer, director, employee, contractor, agent or other representative incurs personal liability to you solely because that person acts or acted in that capacity. This paragraph does not limit responsibility for a person's own conduct where applicable law does not permit that limitation.
2. DEFINITIONS
"Company Parties" means Company and its current and former parents, subsidiaries, affiliates, members, managers, officers, directors, employees, contractors, agents, licensors, service providers, successors, and assigns, in each case to the extent relevant to the conduct or protection addressed by this EULA.
"Company Technology" means, to the extent owned, licensed, developed, or controlled by Company, the Licensed Application and its software, source code, object code, executable code, server-side software, backend systems, services, APIs, interfaces, technical architecture, systems architecture, data models, schemas, taxonomies, algorithms, logic, workflows, methods of organization, databases, compilations, structures, documentation, specifications, designs, layouts, user interfaces, user experience elements, graphics, icons, text, audiovisual materials, trademarks, service marks, logos, trade dress, know-how, confidential technical information, updates, modifications, and other Company-provided technology or content.
Company Technology does not include User Content or third-party material merely because that material appears in or is accessible through GoMaybe.
"Event" means a concert, festival, show, performance, sporting event, comedy event, conference, nightlife event, or other scheduled activity that may be saved, organized, displayed, or referenced through GoMaybe.
"Event Data" means information about an Event, including names, dates, start times, door times, on-sale and presale times, locations, venues, performers, teams, lineups, prices, links, age restrictions, status, availability, policies, and similar factual or descriptive information, whether entered by you, obtained from a third party, or otherwise displayed in GoMaybe.
"External Service" means any third-party website, application, API, platform, calendar, map or location service, ticketing provider, payment service, venue, promoter, organizer, resale marketplace, social platform, email or messaging provider, cloud service, or other third-party product or service accessed, linked, displayed, integrated, or referenced by GoMaybe.
"Ticket Materials" means ticket-related files or information that you save, manually import, link, or otherwise associate with an Event, including PDFs, images, screenshots, confirmation information, provider links, order references, seat information, wristband information, passes, barcodes, QR codes, wallet links, and related records.
"User Content" means content you submit to or store through GoMaybe, including Ticket Materials, notes, event entries, links, screenshots, files or text you choose to provide through an available feature, and other information you provide. User Content does not include Company Technology or Company-owned content.
3. LICENSE GRANT; RESERVATION OF RIGHTS; LICENSE RESTRICTIONS
Subject to your compliance with this EULA, Company grants you a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to use the Licensed Application on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
The Licensed Application may also be accessed and used by other accounts associated with the purchaser through Family Sharing, volume purchasing, Legacy Contacts, or similar functionality to the extent permitted by Apple.
GoMaybe is licensed, not sold.
Company and its licensors retain and reserve all right, title, and interest in and to Company Technology and all rights not expressly granted to you under this EULA.
No implied license is granted.
Except to the extent a restriction is prohibited by applicable law or overridden by an applicable open-source license, you may not, directly or indirectly:
(a) copy, reproduce, distribute, publicly display, publish, sell, rent, lease, lend, sublicense, transfer, assign, or commercially exploit Company Technology except as expressly authorized;
(b) reverse engineer, decompile, disassemble, decode, translate, adapt, modify, derive, discover, or attempt to discover source code, object-code structure, underlying ideas expressed in protected code, nonpublic algorithms, nonpublic protocols, private APIs, or other nonpublic technical components of Company Technology;
(c) create, distribute, or commercially exploit a derivative work based on Company Technology except where applicable law grants a nonwaivable right to do so;
(d) remove, obscure, modify, or falsify copyright, trademark, attribution, license, security, or other proprietary notices;
(e) access GoMaybe through unauthorized automated means, including bots, crawlers, spiders, scrapers, harvesting systems, automated extraction tools, headless clients, scripts, or similar mechanisms;
(f) systematically scrape, crawl, harvest, index, copy, download, aggregate, mine, extract, reconstruct, or republish data obtained through GoMaybe except through functionality Company expressly provides or authorizes;
(g) access, probe, call, reconstruct, or exploit an undocumented, private, internal, or unauthorized API, endpoint, protocol, database, schema, or service;
(h) bypass, disable, circumvent, interfere with, or defeat authentication, authorization, security controls, rate limits, access restrictions, subscription entitlements, purchase validation, geographic restrictions, device restrictions, anti-abuse mechanisms, or other technical measures;
(i) use unauthorized means to obtain paid or restricted functionality without satisfying the applicable purchase, subscription, or authorization requirements;
(j) use Company Technology, unauthorized access to GoMaybe, or data systematically extracted from GoMaybe to develop, train, test, validate, benchmark, improve, replicate, or support a competing software product, database, platform, event-organizing service, or commercial service;
(k) use Company Technology or Company-owned content to train, fine-tune, develop, evaluate, or improve an artificial-intelligence, machine-learning, foundation, or similar computational model for a competing commercial purpose without Company's prior written permission;
(l) use another person's account, credentials, subscription, ticketing account, or entitlement without authorization;
(m) resell, transfer, rent, or commercially traffic in access entitlements except through a mechanism expressly authorized by Company or Apple; or
(n) assist or encourage another person to engage in prohibited conduct described in this Section.
Nothing in this Section claims Company ownership over facts that are not protectable by law, User Content owned by you, or third-party intellectual property merely because the material is displayed through GoMaybe.
Open-source software included in GoMaybe, if any, is governed by its applicable open-source license. If an applicable open-source license conflicts with this EULA as to that component, the open-source license controls for that component.
The foregoing restrictions do not prohibit lawful use of your own User Content, a backup or export permitted by law or available functionality, or accessibility tools that do not unlawfully bypass security or infringe another person's rights. They do not prohibit lawful consumer reviews, criticism, performance assessments, regulatory reports or other protected communications. They do not grant ownership of unprotectable facts or restrict a nonwaivable statutory right. Apple-authorized sharing of access to the app does not itself share your private GoMaybe records or Ticket Materials.
4. DEVICE-LOCAL ACCESS AND USER RESPONSIBILITY
The launch version of GoMaybe does not require a GoMaybe online account or password. It does not provide an online GoMaybe account-recovery service or automatic synchronization of your event library through a Company-operated server.
You are responsible for maintaining a compatible device and operating system and for protecting access to your device. An Apple Account, data connection, external account or permission may be needed for a feature or external service you independently choose to use. Do not provide Company with your Apple or ticket-provider account password.
Device settings, permissions, operating-system changes, storage limits, low-power modes, network conditions and third-party outages may affect particular features. Denying a permission may make the associated feature unavailable without preventing unrelated local features.
You may not impersonate another person, misrepresent your authority, or access another person's device, ticketing, Calendar, Apple or other account without authorization. Protect or remove your private app data before selling, transferring, recycling or relinquishing your device.
Records may become unavailable if the device is lost, reset, damaged or transferred, or app data is deleted. Recovery depends on an available, usable device backup and platform behavior; recovery is not guaranteed. Company does not promise remote access to, restoration of, or deletion from your device.
5. NATURE OF GOMAYBE; ORGANIZATIONAL TOOL; NOT A TICKET SELLER
GoMaybe is designed to help users organize live-event possibilities and related information between discovery and attendance.
Features may include capturing or saving Events, organizing plans using statuses such as Interested, Going, Purchased, and Attended, tracking presale or on-sale information, comparing scheduling conflicts, storing or linking Ticket Materials, and presenting reminders or related records.
Company does not sell, resell, issue, broker, authenticate, transfer, insure, underwrite, or guarantee Event tickets; does not act as an Event promoter, venue, performer, team, primary ticket seller, resale marketplace, or ticket issuer; does not take title to tickets; and does not set the terms governing admission, cancellation, transfer, resale, refund, or Event performance.
A link from GoMaybe to a ticketing or Event provider is provided for convenience and does not make Company the seller, issuer, guarantor, fiduciary, or agent in the resulting transaction.
The labels Interested, Going, Purchased, Attended, or similar statuses are organizational labels only. They are not proof of purchase, proof of ownership, a ticket, reservation, admission credential, guarantee of admission, confirmation that an Event will occur, or representation that a third party recognizes the status.
Any future feature that changes Company's role in ticket transactions would require separately presented, appropriate transaction terms and disclosures before use. Nothing here represents that such a feature is offered.
This EULA does not convert Company into a ticket seller merely because GoMaybe stores, organizes, links to, or displays ticket-related information.
Intent, purchase information and attendance are independent records. A past event date does not itself establish that you attended, and recording attendance does not itself erase purchase history.
6. EVENT DATA: ACCURACY, CHANGES, SOURCE OF TRUTH, AND PROVIDER RIGHTS
Event Data can change at any time and may originate from you, Event organizers, venues, artists, teams, ticketing services, public sources, data providers, or other third parties.
Company does not control most underlying Event Data and does not warrant that Event Data is complete, current, unique, error-free, continuously updated, or appropriate as the sole basis for a purchase, travel, financial, or attendance decision.
Company does not undertake a general duty to independently investigate or verify every item of third-party Event Data unless Company expressly agrees otherwise for a specific feature.
Without limitation, Event Data may be inaccurate, incomplete, stale, duplicated, or changed with respect to an Event's:
date; time; time zone; door time; venue; room; address; performer; team; speaker; lineup; opening acts; age restrictions; accessibility; seating; capacity; presale or on-sale time; presale code; ticket price; fees; inventory; transferability; resale availability; refund eligibility; Event status; postponement; cancellation; curfew; re-entry rules; prohibited items; transportation; parking; other organizer or venue policies.
You are responsible for verifying material Event information through the applicable Event organizer, venue, ticket issuer, ticket seller, or other authoritative source before purchasing a ticket, traveling, incurring expenses, relying on a deadline, or attending.
GoMaybe is not the authoritative source for whether an Event is occurring or whether a ticket remains valid unless Company expressly states otherwise for a particular item of information.
Company may correct or discontinue Company- or provider-supplied material or an integration it controls to address errors, security, rights or legal requirements. This does not grant Company general remote access to edit, merge or erase your private device-local library. Your confirmed corrections and intentional local-retention choices remain subject to the controls and disclosures presented in the app and applicable law.
Third-party data licenses may restrict how long Company may cache, store, display, distribute, or continue using particular Event Data.
You should not rely on GoMaybe as the sole archival source for Event information.
Names, logos, trademarks, event artwork, venue marks, performer names, team names, and other third-party identifiers belong to their respective owners. Their appearance in GoMaybe is for identification or informational purposes and does not imply sponsorship, endorsement, partnership, or affiliation unless Company expressly states otherwise.
Extraction from a screenshot, flyer, image or supplied text can misread or omit information. Venue matching can select an incorrect or ambiguous place. Review suggested dates, times, time zones, sale deadlines and locations before confirming them. Incomplete information may remain unknown and may prevent a reminder or Calendar action. GoMaybe does not continuously monitor issuers, organizers or your saved sources for changes.
7. TICKET MATERIALS; DYNAMIC CREDENTIALS; NO AUTHENTICATION OR GUARANTEE OF ENTRY
GoMaybe may permit you to manually save, import, link, or organize Ticket Materials.
That functionality is a recordkeeping and organizational convenience. It is not a ticket-authentication, validation, verification, transfer, resale, insurance, escrow, fiduciary, custodial, or admission service.
Company does not inspect or guarantee the authenticity, ownership, uniqueness, transfer status, refund status, admissibility, or continuing validity of Ticket Materials.
Some ticketing systems use rotating, refreshing, device-bound, account-bound, encrypted, tokenized, or otherwise dynamic admission credentials.
A screenshot, static image, printed copy, PDF, copied barcode, copied QR code, or other representation stored in GoMaybe may be rejected even if it appears visually complete.
Ticket credentials may also become unusable when a ticket is transferred, resold, refunded, canceled, reissued, replaced, reported lost, associated with suspected fraud, moved to a different account, or otherwise modified or invalidated by the ticket issuer or Event provider.
You are solely responsible for determining the credential format accepted by the applicable issuer or venue and for using the issuer's official application, website, wallet, account, original file, or other required method when necessary.
Saving something in GoMaybe does not:
• authenticate it;
• make it a valid ticket;
• establish ownership;
• guarantee entry;
• preserve a dynamic credential;
• prevent transfer or invalidation; or
• override any ticket-provider or venue rule.
Do not use GoMaybe as the only place where you can access an Event ticket.
Maintain independent access to the original ticketing account, issuer communications, original file, Apple Wallet pass where applicable, or another reliable backup.
Company is not responsible for denial of entry caused by an invalid, copied, expired, transferred, refreshed, inaccessible, unsupported, replaced, canceled, or otherwise unusable credential except to the extent applicable law provides otherwise.
Ticket Materials may have substantial monetary value and may contain personal information, order information, barcodes, QR codes, access tokens, or other credentials capable of unauthorized use.
You are responsible for controlling access to your device, relevant external accounts, and Ticket Materials.
If you believe that a ticket credential has been exposed, copied, stolen, or misused, contact the applicable ticket issuer or seller promptly.
Company does not determine whether a ticket is transferable, resellable, refundable, insured, identity-bound, geographically restricted, or subject to a particular organizer, venue, or issuer policy.
You are responsible for complying with applicable ticket terms and Event rules.
Wallet references and physical wristbands
A Wallet reference reflects information you provide. GoMaybe does not scan your Wallet, verify that a live pass exists, or create, import, refresh or validate a Wallet admission pass. Use the live pass or other entry method required by the issuer.
Pending and Received wristband labels are user-reported organizational states. They do not verify shipment, delivery, ownership, activation or admission validity. A wristband photo never substitutes for a physical wristband required for entry.
Imported reference copies
GoMaybe rebuilds supported imported image copies without their original embedded metadata. New PDF ticket imports preserve the selected original PDF bytes, including information embedded in that file. The app displays PDF pages without activating embedded actions. Older copies may have been flattened and require importing the original again if clarity matters. Image conversion or resizing can affect small text and barcode readability. Review saved copies and keep access to your originals outside GoMaybe. Neither file fidelity nor a saved copy guarantees admission or support for every file format.
Removing ticket information
Confirming removal of an event's Purchased information clears associated local vault details and copies as explained before confirmation. Recording attendance or archiving an event does not by itself erase its purchase history. Removing a file, event or app data does not cancel, transfer or refund a ticket or remove the issuer's records. Section 15 explains additional deletion and backup limits.
8. THIRD-PARTY TICKETING, VENUES, EVENTS, LINKS, AND EXTERNAL SERVICES
GoMaybe may display, integrate with, or link to External Services.
Your dealings with an External Service are between you and that third party and may be governed by separate terms, privacy policies, purchase policies, refund policies, venue rules, ticket limits, transfer rules, resale rules, or other conditions.
You must comply with applicable third-party terms when using GoMaybe in connection with an External Service.
Company does not control and is not responsible for an External Service's:
content; security; privacy practices; availability; performance; pricing; fees; inventory; ticket delivery; transactions; cancellations; refunds; policies; warranties; decisions; outages; acts or omissions.
A third party may change or discontinue its service, API, ticket format, transfer rules, authentication technology, barcode system, pricing, refund policy, integration, or access rights without notice to Company.
Company does not guarantee that a third-party link or integration will remain available or that the third party will honor a ticket, listing, price, presale, refund, transfer, reservation, or other representation.
You should review applicable third-party terms before purchasing, transferring, or relying upon anything of value.
Company may suspend or remove an integration, data source or Company-provided link that it controls, including if the provider limits access, changes technical requirements, requires removal of content, asserts rights in data, creates security risk, or creates legal or operational risk.
Company does not control Event premises, physical security, crowd management, accessibility, transportation, parking, weather, age checks, identity checks, prohibited-item rules, or other conditions at an Event or venue.
Verify material safety, accessibility, admission, and venue-policy information directly with the applicable organizer or venue.
Nothing in this Section limits liability that applicable law does not permit to be disclaimed or limited.
External actions and venue assistance
Opening a saved source or ticket-provider link requires your deliberate action and confirmation of the destination. The destination receives the saved link and ordinary connection information; a ticket URL may itself contain sensitive information. GoMaybe does not add unrelated Calendar data, private notes, ticket files or purchase details to that handoff. Review the destination before continuing.
Get Directions hands a reviewed venue/address/city destination to Apple Maps after confirmation. GoMaybe does not supply your device's current location as an origin. Apple Maps may use its own permissions and practices after it opens.
When venue lookup is enabled, it may run automatically during import or review using a venue name and necessary event-source city or region information. The provider also receives ordinary network/request information. GoMaybe does not send the source image, full extracted text, private Calendar contents, ticket details, private notes or user/photo GPS for that lookup. The Privacy Policy identifies the enabled provider and relevant practices. Offline or unavailable lookup does not guarantee enrichment of an event.
Selecting an item from Files or Photos may cause your chosen system or cloud provider to retrieve that item. This is distinct from Company operating a remote copy of your event library. GoMaybe does not connect to your ticket-provider account or automatically import your email through these features.
9. CALENDAR, CONFLICTS, LOCAL REMINDERS AND TIME-SENSITIVE INFORMATION
Calendar comparison uses the access you choose to grant and processes the comparison on your device. Calendar permission alone does not authorize automatic changes. Adding an entry requires your action, and each app-performed update to a linked entry requires your approval. Changing a GoMaybe record does not automatically change the Calendar copy. Your Calendar provider may synchronize entries you choose to add.
You may revoke Calendar or notification permissions through device settings. Related features may then be unavailable. GoMaybe continues to support unrelated internal event tracking. Deleting app data does not itself delete entries already copied to an external Calendar.
Conflict detection and Calendar comparison are assistance features, not guarantees. Results may be incomplete or wrong because of missing access, hidden calendars, unknown or stale dates/times, time-zone or daylight-saving conversions, recurring or all-day events, manual edits, synchronization, provider errors, or device behavior. A possible conflict is not proof of overlap, and absence of a warning does not establish availability. Check your authoritative calendars and schedule.
GoMaybe's ticket-sale reminders use local notifications based on saved information and your choices. They do not continuously monitor issuers, inventory or changed sale times. Confirm inferred critical sale timing before enabling an alert. Already enabled reminders remain subject to device permission, valid timing, app settings and applicable event/deletion controls.
Delivery is not guaranteed. A reminder may be delayed, duplicated, suppressed, displayed too late or not delivered because of device settings, operating-system restrictions, inaccurate saved information, capacity limits, scheduling errors or other conditions. Restoring an event does not by itself authorize reactivation of its reminders.
Notifications may show the event name by default. You may choose Hide Event Names to use generic wording; iOS separately controls notification-preview visibility. Notification content excludes ticket files and barcodes, confirmation/order numbers, seat details, prices/fees, purchaser notes and personal-Calendar conflict details.
Do not rely on GoMaybe as your sole means of meeting a purchase, presale, transfer, refund, check-in, venue-entry or event-start deadline. Independently verify time-sensitive information and act through the authoritative provider.
10. APP STORE PURCHASES AND ANY SEPARATELY OFFERED PAID FEATURES
This Section applies only if a paid download, purchase or subscription is separately offered. It does not represent that the launch version includes a paywall or subscription.
If GoMaybe offers a paid download, in-app purchase, auto-renewable subscription, or other purchase through Apple's In-App Purchase system, the applicable purchase interface will disclose the price, billing period, renewal terms, trial or promotional terms if any, and functionality offered, as required by Apple and applicable law.
Apple's payment terms and Apple Media Services Terms govern processing of App Store transactions.
Unless otherwise disclosed, Company does not directly receive or store your complete payment-card number for transactions processed by Apple.
Apple may handle billing, payment processing, tax collection, subscription management, and refund processing under Apple's rules and applicable law.
Auto-renewable subscriptions renew as disclosed in the applicable purchase flow until canceled.
You are responsible for managing an Apple-billed subscription through the applicable Apple subscription-management functionality or another cancellation method required by applicable law.
Deleting GoMaybe or its local app data does not by itself cancel an Apple auto-renewable subscription, if you have purchased one. Apple billing may continue until it is canceled through the applicable subscription-management process.
Where required, the applicable purchase or cancellation interface will provide access to subscription-management functionality. This EULA does not replace transaction-specific disclosures, consent or cancellation rights.
Cancellation generally prevents future renewals and does not automatically generate a retroactive refund for an already-started subscription period unless Apple, Company, or applicable law provides otherwise.
Purchases may be restored where Apple requires or enables restoration.
Any Event ticket purchase made through an External Service is separate from a GoMaybe App Store purchase and is governed by the ticket seller's terms.
Company does not owe you a ticket refund merely because an Event is canceled, postponed, moved, modified, or inaccessible unless Company is legally responsible for the underlying ticket transaction or applicable law otherwise requires.
Company may add, modify, discontinue, or repackage paid functionality prospectively subject to applicable law. Where legally required, Company will provide appropriate notice, continued access, refund rights, or other remedies.
11. USER CONTENT; LIMITED OPERATIONAL PERMISSION
As between you and Company, you retain ownership of your User Content, subject to third-party rights. Company does not obtain ownership of a ticket, image, note, event entry or other material merely because you save it in GoMaybe.
You grant Company a non-exclusive, royalty-free permission to cause GoMaybe to process, reproduce, format, store and display your User Content only as reasonably necessary to perform the features you use, including local extraction, reference-copy conversion and display. An external transmission is limited to a separately disclosed enabled feature or an action you choose, subject to any legally required permission or consent.
This permission does not authorize Company to publish private content, use it for advertising or model training, or obtain unrelated Calendar, photo, ticket-provider or account information. The launch version does not maintain a Company-operated server repository of your saved event records or Ticket Materials. It does not provide general remote monitoring, moderation or access to your private library.
For an item kept solely in the app, the operational permission ends when the item is removed from current app-controlled storage, except as needed to complete the removal. User-controlled device backups and external originals remain subject to Section 15 and the relevant platform's practices. This provision does not authorize Company to retain undisclosed server copies for backup, investigation or legal purposes.
If you separately choose to send material to Company for support or a legal request, Company may use that submitted material only for the stated purpose, necessary related security or legal handling, and as accurately described in the Privacy Policy. That submission does not give Company access to the rest of your device library. Avoid sending ticket credentials or unrelated private content.
You must have the rights and permissions needed for your use of the material and the limited processing you authorize. Do not provide stolen ticket credentials, unlawfully obtained personal information, malicious content, infringing material, or information you are prohibited by law or contract from providing. Saving a reference does not grant you new rights in someone else's artwork, ticket or information.
Company may restrict material you actually submit to Company or services it controls when reasonably necessary to address a legal obligation, security incident or material misuse. This does not create a right or technical ability to inspect or remove your private device-local records remotely.
Maintain independent copies of important content. Except for obligations imposed by applicable law, Company does not undertake to serve as your archival, escrow, fiduciary, custodial or backup provider.
12. PROHIBITED AND HIGH-RISK USES
You may not use GoMaybe to violate any applicable law, regulation, court order, third-party right, or applicable ticketing or venue rule.
Without limitation, you may not use GoMaybe to:
(a) obtain, store, distribute, sell, transfer, or facilitate use of stolen, counterfeit, fraudulent, fraudulently duplicated, or unauthorized tickets or credentials;
(b) circumvent ticket-purchasing limits, queues, access controls, anti-bot measures, identity checks, geographic controls, security controls, or similar restrictions;
(c) coordinate or facilitate conduct prohibited by the federal Better Online Ticket Sales Act or similar federal, state, or local law;
(d) evade a ticket issuer's or seller's purchasing rules through fake identities, unauthorized accounts, account farms, automated tools, or deceptive technical measures;
(e) scrape, crawl, harvest, index, mine, copy, or extract data through unauthorized automated means;
(f) use credential stuffing, password spraying, brute force, token replay, session hijacking, or similar techniques;
(g) probe, scan, test, or exploit a vulnerability without Company's prior written authorization;
(h) interfere with, overload, flood, disrupt, damage, disable, or impair GoMaybe or related systems;
(i) transmit malware, ransomware, spyware, destructive code, or other harmful technology;
(j) attempt unauthorized access to accounts, systems, data, infrastructure, APIs, administrative functions, or nonpublic functionality;
(k) bypass or defeat subscription, entitlement, authentication, authorization, security, or anti-abuse controls;
(l) impersonate another person or misrepresent identity, authority, sponsorship, or affiliation;
(m) infringe or misappropriate intellectual-property, privacy, publicity, confidentiality, contractual, or other rights;
(n) use GoMaybe for fraud, money laundering, unlawful resale, or other unlawful commercial activity;
(o) use Company Technology or unauthorized extracted information to clone or materially replicate GoMaybe or a protected portion of Company Technology;
(p) use Company Technology or systematically extracted GoMaybe data to train or develop a competing commercial AI, machine-learning, software, database, or event-organizing product without Company's prior written permission; or
(q) assist another person in engaging in prohibited conduct.
Company may investigate suspected misuse using information it lawfully holds and may preserve or disclose that information where permitted or required by law and consistent with the Privacy Policy. This does not authorize undisclosed monitoring or remote access to your private device library.
Company may cooperate with lawful requests from courts, regulators, law enforcement agencies, rights holders, Event organizers, venues, infrastructure providers, and other legally authorized parties.
The lawful-user-content, accessibility, review and nonwaivable-rights protections in Section 3 apply to these restrictions as well.
13. INTELLECTUAL PROPERTY; COMPANY TECHNOLOGY; TRADEMARKS; FEEDBACK
Company Technology is owned by Company or its licensors and may be protected by copyright, trademark, trade-secret, contract, database, unfair-competition, and other applicable laws.
To the extent owned or licensed by Company, protected Company Technology includes, without limitation:
source code; object code; server-side code; backend infrastructure and services; APIs and nonpublic protocols; technical and systems architecture; application structure; data models; database schemas; taxonomies; algorithms; software logic; workflows; organization and compilations; UI and UX elements; interface designs; text; graphics; icons; documentation; specifications; branding; trade dress; domain-related branding; trademarks; service marks; confidential technical information; know-how; updates; modifications; Company-created improvements and derivative works.
All rights not expressly granted in Section 3 are reserved.
Nothing in this EULA transfers to you ownership of Company Technology or Company's intellectual-property rights.
Your access to the Licensed Application does not grant you access to or a license in Company's source code, trade secrets, confidential systems, nonpublic APIs, or other nonpublic information.
Unauthorized access, observation, possession, or acquisition of nonpublic Company Technology does not transfer ownership or create a license.
GoMaybe, associated logos, branding, and other Company marks are trademarks, service marks, trade names, or other source identifiers of Company to the extent protected by applicable law.
Third-party Event names, ticketing names, venue names, artist names, team names, logos, marks, artwork, and other third-party content remain the property of their respective owners.
Nothing in this EULA claims Company ownership over third-party intellectual property or factual information that applicable law does not permit Company to own.
Feedback
If you voluntarily provide suggestions, concepts, comments, ideas, feature requests, or other feedback regarding GoMaybe ("Feedback"), you grant Company a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable license to use, reproduce, modify, adapt, develop, commercialize, and otherwise exploit that Feedback without restriction or compensation.
Company will not publicly identify you as the source of Feedback without permission unless legally permitted or required.
Feedback does not include User Content that you merely store through GoMaybe without intending to provide it to Company as product feedback.
You retain ownership of your Feedback. No provision transfers ownership of a protected consumer review, prohibits lawful criticism or performance assessment, or penalizes a communication protected by law. This does not permit infringement, unlawful disclosure of trade secrets or disclosure of another person's protected private information.
14. PRIVACY AND PERMISSIONS
Company's Privacy Policy describes the information Company handles, enabled external data flows, support/legal communications, relevant providers, retention, deletion, security and user rights. The policy is available at the Privacy Policy address in Section 28 and through the app's legal-information access.
The policy is separate from this EULA except as applicable law or an express provision requires otherwise. Accepting this EULA is not blanket consent to unrelated data collection, advertising, tracking, marketing or a new external service.
You control applicable device permissions for Calendar, notifications, camera, selected images or files. A saved planning city, a public venue location and your device's physical location are different information. GoMaybe does not continuously track your movement or request your device location for the directions handoff described in Section 8.
If an optional selected-photo metadata feature is made available, its purpose and choice will be explained when relevant. A remembered choice must be explicit and revocable. Such a feature does not authorize broad photo-library scanning, continuous location access, retention of raw photo GPS or transmission of user/photo GPS for venue lookup. No feature is promised merely because its permission boundary is described here.
Denying or revoking a permission may limit its related functionality. Nothing in this EULA waives or limits a nonwaivable privacy right or remedy. If a provision could reasonably be interpreted otherwise, the mandatory privacy protection controls.
15. SECURITY, CREDENTIAL PROTECTION, BACKUPS, AND RISK ALLOCATION
Company remains responsible for the security duties applicable to the information it handles. Safeguards and risk allocations in this EULA do not replace a mandatory duty to use reasonable security.
No electronic system can be guaranteed completely secure, continuously available, immune from attack, or free of errors.
Company does not warrant absolute security or uninterrupted preservation of User Content or Ticket Materials.
You are responsible for:
• securing your device with an appropriate passcode or biometric control;
• maintaining control of your Apple Account and linked accounts;
• installing relevant security and operating-system updates;
• maintaining control of authentication credentials;
• avoiding unauthorized sharing of ticket or account credentials; and
• promptly using available device and account security tools if a device is lost, stolen, compromised, or transferred.
Because Ticket Materials may provide access to Events with monetary value, you assume the ordinary risks inherent in choosing to store ticket-related information through GoMaybe, except to the extent a loss is caused by conduct for which applicable law does not permit Company to disclaim or limit liability.
The storage or organization of Ticket Materials does not create an escrow, bailment, fiduciary, insurance, custodial, or safekeeping relationship except to the extent applicable law expressly provides otherwise.
Do not place complete payment-card numbers, account passwords, government identification documents or Social Security numbers in GoMaybe or send them to support. The ticket-reference features do not require these items.
Local storage, deletion and device backups
GoMaybe manages saved events and reference copies in its on-device app storage. Supported records remain until you intentionally remove them through the available controls, subject to corruption, device loss, storage failure or a legally necessary action disclosed as applicable. Local storage alone is not a separate backup.
Your normal device backup may hold another copy. Recovery depends on your backup settings, platform behavior and an available usable backup; Company does not guarantee restoration or immediately erase older backups.
Delete All App Data is intended to remove current app-controlled records and preferences and cancel the associated app-owned reminders. It clears local Calendar linkage rather than deleting external Calendar entries. Original Photos/Files, issuer records, destinations you visited and historical backups remain outside that deletion. A failed step can leave a partial result; review the app's result rather than assuming every operation succeeded. Individual file/event removal and Purchased removal have the effects explained in their respective confirmations.
These boundaries do not restrict any deletion or other privacy remedy that applicable law makes nonwaivable.
16. SERVICE AVAILABILITY; CHANGES; UPDATES; BETA FEATURES; EVENTS BEYOND COMPANY CONTROL
GoMaybe may evolve over time.
Subject to applicable law, Company may add, modify, limit, replace, suspend, or discontinue GoMaybe or any portion of GoMaybe, including features, interfaces, integrations, Event Data sources, functionality, technical requirements, or supported devices.
Company may issue updates necessary for security, compatibility, functionality, legal compliance, provider requirements, or continued operation.
Company does not guarantee that a particular feature, integration, External Service, Event Data source, ticket format, provider connection, third-party link, or supported device will remain available indefinitely.
Company will provide notice and remedies required by law for material changes, including changes that materially reduce a paid service. Where reasonably practicable, Company will also provide advance notice of substantial discontinuation. These powers do not grant general remote access to edit or delete your private device library.
Features identified as beta, preview, experimental, prototype, test, or pre-release may be incomplete, unstable, inaccurate, unavailable, or changed or withdrawn without notice and are provided subject to the warranty disclaimers and liability limitations in this EULA.
To the maximum extent permitted by applicable law, Company is not liable for delay or failure caused by circumstances beyond its reasonable control, including:
Apple service failures; cloud-provider outages; telecommunications failures; internet disruptions; third-party API changes; ticket-provider outages; cyberattacks; distributed denial-of-service attacks; labor disputes; fire; flood; earthquake; severe weather; natural disaster; epidemic or public emergency; war; terrorism; civil disorder; governmental action; power failure; other similar events outside Company's reasonable control.
An incident is not outside Company's reasonable control merely because it is labeled a cyberattack or outage. This Section does not exclude liability or a duty that applicable law preserves.
17. MAINTENANCE AND SUPPORT
Company, not Apple, is solely responsible for providing maintenance and support for the Licensed Application to the extent specified by Company or required by applicable law.
Apple has no obligation whatsoever to furnish maintenance or support services for GoMaybe.
Support communications, estimated response times, acknowledgments, automated messages, status notices, or bug reports do not create a service-level agreement, guarantee, or warranty unless Company expressly agrees otherwise in a signed writing or applicable law requires otherwise.
18. WARRANTY DISCLAIMER
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOMAYBE, THE LICENSED APPLICATION, COMPANY TECHNOLOGY MADE AVAILABLE TO USERS, EVENT DATA, TICKET-ORGANIZATION FEATURES, USER-CONTENT STORAGE FEATURES, NOTIFICATIONS, INTEGRATIONS, EXTERNAL-SERVICE CONNECTIONS, BETA FEATURES, AND RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMPANY AND THE COMPANY PARTIES DISCLAIM IMPLIED WARRANTIES OR CONDITIONS OF:
• MERCHANTABILITY;
• SATISFACTORY QUALITY;
• FITNESS FOR A PARTICULAR PURPOSE;
• TITLE;
• QUIET ENJOYMENT;
• ACCURACY;
• RELIABILITY;
• NON-INFRINGEMENT; AND
• WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
COMPANY DOES NOT WARRANT THAT GOMAYBE WILL:
• BE UNINTERRUPTED;
• BE ERROR-FREE;
• BE COMPLETELY SECURE;
• BE FREE OF HARMFUL COMPONENTS;
• FUNCTION WITH EVERY DEVICE OR THIRD-PARTY SERVICE;
• PRESERVE EVERY ITEM OF USER CONTENT OR TICKET MATERIALS;
• IDENTIFY EVERY CALENDAR CONFLICT;
• DELIVER EVERY NOTIFICATION; OR
• PROVIDE EVENT DATA, REMINDERS, LINKS, TICKET MATERIALS, OR CONFLICT RESULTS THAT ARE ALWAYS COMPLETE, CURRENT, ACCURATE, OR RELIABLE.
GENERAL SUPPORT GUIDANCE, ESTIMATES AND STATEMENTS OF OPINION DO NOT CREATE ADDITIONAL WARRANTIES UNLESS APPLICABLE LAW PROVIDES OTHERWISE. NOTHING IN THIS EULA EXCLUDES AN EXPRESS WARRANTY OR OTHER BINDING REPRESENTATION RECOGNIZED BY APPLICABLE LAW, OR RESPONSIBILITY FOR MISLEADING STATEMENTS WHERE THAT RESPONSIBILITY CANNOT LAWFULLY BE LIMITED.
SOME STATES OR JURISDICTIONS DO NOT PERMIT CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
YOU RETAIN ALL NONWAIVABLE RIGHTS AVAILABLE UNDER APPLICABLE LAW.
If the Licensed Application fails to conform to an applicable warranty that has not been effectively disclaimed, you may notify Apple, and Apple will refund the purchase price, if any, for the Licensed Application.
To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to GoMaybe.
Company, not Apple, is solely responsible for other claims, losses, liabilities, damages, costs or expenses attributable to failure to conform to an applicable warranty. This allocation does not create a warranty that has otherwise been lawfully disclaimed.
19. LIMITATION OF LIABILITY
THE EXCLUSIONS AND MONETARY CAP BELOW DO NOT APPLY TO LIABILITY, RIGHTS OR REMEDIES THAT APPLICABLE LAW PROHIBITS US FROM EXCLUDING OR LIMITING.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY PARTIES WILL NOT BE LIABLE FOR:
INDIRECT DAMAGES; INCIDENTAL DAMAGES; SPECIAL DAMAGES; EXEMPLARY DAMAGES; PUNITIVE DAMAGES; CONSEQUENTIAL DAMAGES; LOSS OF PROFITS; LOSS OF REVENUE; LOSS OF BUSINESS; LOSS OF GOODWILL; LOSS OF OPPORTUNITY; LOSS OF DATA; LOSS OF USE; COST OF SUBSTITUTE PRODUCTS OR SERVICES.
ARISING OUT OF OR RELATING TO GOMAYBE OR THIS EULA, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
WITHOUT LIMITING THE PRECEDING PARAGRAPH, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY PARTIES WILL NOT BE LIABLE FOR LOSSES ARISING OUT OF OR RELATING TO:
A MISSED EVENT; A MISSED PRESALE; A MISSED ON-SALE; A MISSED REFUND DEADLINE; A MISSED TRANSFER DEADLINE; A MISSED CHECK-IN OR ENTRY DEADLINE; DENIAL OF ENTRY; AN INVALID TICKET; A DUPLICATED TICKET; A REFRESHED OR ROTATING CREDENTIAL; A TRANSFERRED TICKET; A REISSUED TICKET; A CANCELED TICKET; A REFUNDED TICKET; AN EXPIRED TICKET; AN INACCESSIBLE TICKET; AN OTHERWISE UNUSABLE TICKET; EVENT CANCELLATION; EVENT POSTPONEMENT; EVENT RELOCATION; LINEUP CHANGE; VENUE-POLICY CHANGE; TICKET-PRICE OR FEE CHANGES; TICKET AVAILABILITY OR INVENTORY; TRAVEL COSTS; HOTEL COSTS; PARKING COSTS; TRANSPORTATION COSTS; FOOD COSTS; MERCHANDISE COSTS; VIP OR EVENT-RELATED COSTS; AN INACCURATE CALENDAR OR CONFLICT RESULT; A FAILED, DELAYED, DUPLICATED, OR MISDIRECTED NOTIFICATION; LOSS, DELETION, OR CORRUPTION OF TICKET MATERIALS OR USER CONTENT; THE FAILURE OR CHANGE OF AN EXTERNAL SERVICE; THE ACTS OR OMISSIONS OF AN EVENT ORGANIZER, VENUE, TICKET PROVIDER, SELLER, RESELLER, ARTIST, TEAM, PROMOTER, OR OTHER THIRD PARTY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF THE COMPANY PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE LICENSED APPLICATION OR THIS EULA WILL NOT EXCEED THE GREATER OF:
(A) FIFTY U.S. DOLLARS (US $50); OR
(B) THE AMOUNT YOU PAID FOR GOMAYBE THROUGH THE APP STORE DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE FORM OR THEORY OF LIABILITY, INCLUDING CONTRACT, WARRANTY, TORT, ORDINARY NEGLIGENCE, STRICT LIABILITY, STATUTE, OR OTHERWISE, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
THESE LIMITATIONS DO NOT EXCLUDE OR LIMIT LIABILITY, RIGHTS, OR REMEDIES TO THE EXTENT APPLICABLE LAW PROHIBITS THE EXCLUSION OR LIMITATION, INCLUDING LIABILITY OR RIGHTS THAT CANNOT LAWFULLY BE LIMITED FOR FRAUD, WILLFUL MISCONDUCT, WILLFUL INJURY, GROSS NEGLIGENCE, CERTAIN PERSONAL INJURIES, VIOLATIONS OF LAW, OR NONWAIVABLE CONSUMER OR PRIVACY RIGHTS.
The allocation of risk in this Section is an essential basis of the bargain between you and Company.
To the maximum extent permitted by applicable law, the protections of this Section apply separately to each Company Party, and each Company Party is an intended third-party beneficiary of these protections.
20. LIMITED THIRD-PARTY INDEMNIFICATION
To the extent permitted by applicable law, you will indemnify the Company Parties for third-party claims and reasonable, documented defense costs to the extent caused by your unlawful or fraudulent use of GoMaybe, intentional infringement or misappropriation of another person's rights, knowing material breach of this EULA, unauthorized trafficking in ticket credentials, or intentional unauthorized attack on Company systems.
This obligation does not apply to the extent caused by a Company Party's negligence, misconduct, breach of this EULA or violation of law. It does not require indemnification for a nonwaivable consumer, privacy or other statutory duty, your good-faith assertion of a protected claim, or costs that applicable arbitration rules or law prohibit shifting to you.
Company will provide reasonably prompt notice and a reasonable opportunity to participate in the defense. Delay in notice reduces your obligation to the extent it materially prejudices you. Company may manage the defense using reasonable measures and costs, but may not impose a settlement payment, admission or other obligation on you without your consent.
This Section does not impose a separate immediate duty for you to assume or advance the cost of Company's defense before your responsibility is established by a final determination or an agreed settlement. This express limitation controls any otherwise applicable default interpretation of a duty to defend. You will provide reasonable cooperation without being required to disclose unrelated private information.
21. SUSPENSION, TERMINATION, AND EFFECT OF TERMINATION
You may stop using GoMaybe at any time.
Company may terminate your license or restrict Company-controlled services, functionality or submitted content, to the extent it can lawfully do so, if Company reasonably believes that:
you materially violated this EULA; you engaged in fraud; you created a security risk; you attempted unauthorized access; you abused or attacked Company systems; you infringed or misappropriated rights; you misused ticketing systems; your use violates applicable law; your use threatens the integrity, security, availability, or lawful operation of GoMaybe; a required payment or entitlement is invalid or no longer active; an External Service or infrastructure provider requires suspension; a court, regulator, government authority, or legal obligation requires suspension; continued access would expose Company, users, or third parties to material legal, security, or operational risk.
Where applicable law requires notice, proportionality, or an opportunity to cure, Company will comply with those requirements.
Company may act immediately where Company reasonably believes immediate action is necessary to address fraud, unlawful conduct, a cybersecurity incident, credential compromise, unauthorized access, or imminent harm.
Because loss of GoMaybe access may affect access to Ticket Materials, you should maintain independent access to original ticket-provider accounts and credentials.
Termination of GoMaybe does not cancel or refund a ticket purchased from a third party.
Upon termination, the license granted in Section 3 terminates.
Termination does not eliminate rights or obligations that arose before termination.
Sections that by their nature should survive will survive termination, including provisions concerning:
ownership; Company Technology; license restrictions; Feedback; ownership of User Content; payment obligations already incurred; disclaimers; limitation of liability; indemnification; dispute resolution; governing law; Apple third-party-beneficiary rights; General Terms.
Termination of a legal license does not imply that Company can remotely inspect or erase device-local records. It does not transfer ownership of your User Content. Any handling of material Company actually holds remains subject to the Privacy Policy and applicable law.
22. DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS WAIVER; OPT-OUT
22.1 Informal Resolution First
Before filing arbitration or a lawsuit other than an eligible small-claims matter or a request for emergency or provisional relief permitted under Section 22.12, the complaining party must send the other party a written Notice of Dispute.
The Notice must provide reasonably sufficient information to identify:
• the complaining party;
• appropriate contact information;
• the account involved, if applicable;
• the facts giving rise to the dispute;
• the legal basis of the dispute, if known; and
• the relief requested.
Send notices to Company using Section 28. The suggested email subject line is:
Notice of Dispute
The parties will attempt in good faith to resolve the dispute for 60 days after receipt of a Notice containing reasonably sufficient information. An immaterial omission or different subject line does not invalidate an understandable notice. The recipient may request reasonably necessary missing details.
Any applicable limitations period will be tolled during that 60-day period to the extent permitted by applicable law.
22.2 Agreement to Arbitrate
Except for matters expressly excluded by this Section, you and Company agree that disputes, claims, or controversies arising out of or relating to this EULA, GoMaybe, or your relationship with Company will be resolved through binding individual arbitration rather than in court.
The Federal Arbitration Act, 9 U.S.C. §§ 1-16, governs interpretation and enforcement of this arbitration agreement.
22.3 Administrator and Rules
Arbitration will be administered by the American Arbitration Association ("AAA") under its then-current Consumer Arbitration Rules and Mediation Procedures and, if AAA determines they apply, its then-current Mass Arbitration Supplementary Rules or successor rules.
If AAA is generally unavailable for a reason unrelated to a party's misconduct, fee nonpayment or failure to meet applicable consumer-arbitration requirements, the parties may agree on another neutral administrator or seek an appointment permitted by the Federal Arbitration Act. This provision does not restrict a party's right to proceed in court when AAA declines or ends administration under Rule R-10 or when applicable law otherwise permits that election. Current AAA rules are available at https://www.adr.org/.
Unless applicable AAA rules require otherwise, an individual arbitration will be conducted by one neutral arbitrator.
The arbitrator may award the same individual remedies a court could award, subject to applicable nonwaivable rights and lawful limitations.
22.4 Consumer Fairness; Location; Fees
If you are a consumer, a hearing will occur by video, telephone, document submission, or in the county or parish of your residence as permitted by AAA's Consumer Arbitration Rules and selected consistently with those rules.
Your filing fee will not exceed the amount applicable AAA consumer rules require a consumer to pay, or a lower amount required by applicable law.
Company will pay arbitration fees that AAA rules or applicable law require Company to pay.
Each party bears its own attorneys' fees unless a statute, applicable rule, settlement, or arbitral award permits fee shifting.
22.5 Small Claims and Government Enforcement
Either party may bring an individual action in a court of competent jurisdiction that qualifies as small claims, provided the action remains individual and within that court's jurisdiction.
Nothing in this EULA prevents you from reporting concerns to, cooperating with, or seeking relief through a federal, state, or local government agency to the extent applicable law permits.
Government agencies may enforce applicable law regardless of this arbitration agreement.
22.6 Public Injunctive Relief and Other Nonwaivable Rights
Nothing in this EULA waives a right to seek public injunctive relief or another remedy that applicable law does not permit to be waived.
A legally available request for public injunctive relief may be pursued in an appropriate forum. If another restriction in this Section would prevent the arbitrator from awarding that relief, or applicable law requires court adjudication, the request may be pursued in a court of competent jurisdiction.
To the extent permitted by applicable law, arbitrable claims may proceed first and a court may stay a non-arbitrable request while arbitration is pending.
Nothing in this Section waives or limits nonwaivable privacy, consumer-protection, or statutory rights.
22.7 Class and Representative Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE PROCEEDING.
THE ARBITRATOR MAY NOT PRESIDE OVER A CLASS OR REPRESENTATIVE PROCEEDING OR AWARD RELIEF TO PERSONS WHO ARE NOT PARTIES TO THE INDIVIDUAL ARBITRATION EXCEPT TO THE EXTENT APPLICABLE LAW REQUIRES OTHERWISE.
This subsection does not prohibit administrative coordination of individual arbitrations under applicable AAA Mass Arbitration Supplementary Rules. Claims and remedies remain individual except as applicable law requires or the affected parties expressly agree. Nothing in this subsection eliminates a nonwaivable right or remedy.
22.8 Jury-Trial Waiver
For a dispute properly resolved in court rather than arbitration:
YOU AND COMPANY WAIVE TRIAL BY JURY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
This waiver does not apply in a California state-court proceeding where prohibited by California law, or in any other proceeding where applicable law makes it ineffective. Agreeing to arbitration is distinct from waiving a jury in a court proceeding.
22.9 Court Decides Formation and Enforceability
Unless applicable law requires otherwise, a court of competent jurisdiction, rather than the arbitrator, will decide disputes concerning whether an arbitration agreement was formed and whether this arbitration agreement or the class-action waiver is enforceable.
The arbitrator will decide the merits of arbitrable claims and procedural issues properly assigned to the arbitrator under applicable law and the governing AAA rules.
22.10 Right to Opt Out of Arbitration
You may opt out of Sections 22.2 through 22.9 by sending Company a written opt-out notice within 30 days after the date you first accept this EULA.
The notice must include:
• your full name;
• a contact email or mailing address at which Company can respond; and
• a clear statement that you are opting out of the arbitration agreement in the GoMaybe EULA.
Send the notice to the support/legal email address in Section 28. The suggested subject is:
Arbitration Opt-Out
or send it by mail to the business mailing address in Section 28.
No GoMaybe account, device identifier or disclosure of your ticket or Calendar content is required. A different subject line does not invalidate a clear, timely opt-out. A mailed opt-out is timely if postmarked within the 30-day period.
Opting out removes the arbitration and class/jury restrictions within Sections 22.2 through 22.9 as to you. It does not affect access to GoMaybe or eliminate any mandatory right. Company will retain a valid opt-out as needed to honor it under the Privacy Policy. A prior valid opt-out remains effective unless you later expressly agree otherwise.
22.11 Severability of Dispute Terms
If a portion of this Section 22 is found invalid or unenforceable, it will be severed or limited to the minimum extent necessary so that the remainder may be enforced, except where applicable law prohibits severance in the circumstances presented.
No interpretation of this severability clause is intended to waive a nonwaivable right.
22.12 Emergency and Provisional Equitable Relief
Notwithstanding the arbitration requirement, either party may seek a temporary restraining order, preliminary injunction, or other temporary or provisional equitable relief from a court of competent jurisdiction when reasonably necessary to:
• prevent or stop unauthorized system access;
• address an active or threatened cybersecurity incident;
• prevent unauthorized use or disclosure of credentials;
• prevent infringement or misappropriation of intellectual property;
• prevent misuse or disclosure of trade secrets or confidential nonpublic technology;
• preserve evidence; or
• preserve the status quo pending arbitration.
Seeking temporary or provisional relief under this subsection does not waive the right or obligation to arbitrate the merits of an otherwise arbitrable dispute.
23. GOVERNING LAW AND FORUM FOR NON-ARBITRABLE DISPUTES
Except to the extent federal law controls or your home state's law provides nonwaivable consumer rights that must apply, this EULA and disputes arising out of or relating to it are governed by the laws of the State of California, without regard to conflict-of-laws principles.
The Federal Arbitration Act governs Section 22.
For a dispute that is not subject to arbitration and is not an eligible small-claims matter, the parties consent to the state and federal courts located in San Francisco, California, except where applicable law gives you a nonwaivable right to bring the dispute elsewhere.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
24. APPLE APP STORE REQUIRED TERMS
24.1 Acknowledgement
This EULA is concluded between you and Company only and not with Apple.
Company, not Apple, is solely responsible for the Licensed Application and its content.
This EULA will not provide usage rules that conflict with the Apple Media Services Terms and Conditions, applicable Volume Content Terms or other applicable Apple usage rules as of the Effective Date.
24.2 Scope of License
Your license is limited to a non-transferable license to use the Licensed Application on Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
The Licensed Application may also be accessed and used by other accounts associated with the purchaser through Family Sharing, volume purchasing, Legacy Contacts, or other Apple functionality to the extent Apple permits.
24.3 Maintenance and Support
Company is solely responsible for maintenance and support services concerning the Licensed Application as specified in this EULA or required by applicable law.
Apple has no obligation to furnish maintenance or support services concerning GoMaybe.
24.4 Warranty
Company is solely responsible for product warranties, whether express or implied by law, to the extent not effectively disclaimed.
If the Licensed Application fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the Licensed Application.
To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the Licensed Application.
Company, not Apple, is solely responsible for other claims, losses, liabilities, damages, costs or expenses attributable to failure to conform to an applicable warranty. This allocation does not create a warranty that has otherwise been lawfully disclaimed.
24.5 Product Claims
Company, not Apple, is responsible for addressing claims by you or a third party relating to the Licensed Application or your possession and use of it, including:
• product-liability claims;
• claims that the Licensed Application fails to conform to applicable legal or regulatory requirements; and
• claims arising under consumer-protection, privacy, or similar legislation.
Nothing in this EULA limits Company's liability beyond what applicable law permits.
24.6 Intellectual-Property Claims
If a third party claims that the Licensed Application or your possession and use of it infringes that third party's intellectual-property rights, Company, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that intellectual-property infringement claim.
24.7 Legal Compliance
You represent and warrant that:
(a) you are not located in a country or region subject to a United States Government embargo or designated by the United States Government as a terrorist-supporting country; and
(b) you are not listed on a United States Government list of prohibited or restricted parties.
24.8 Developer Contact
Company's name, business mailing address, telephone number, and email address for questions, complaints, or claims concerning the Licensed Application are listed in Section 28.
24.9 Third-Party Terms
You must comply with applicable third-party terms when using the Licensed Application, including applicable Apple terms, wireless-data terms, calendar or cloud-service terms, and ticketing, venue, Event-provider, or External-Service terms.
24.10 Third-Party Beneficiary
You and Company acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA.
Upon your acceptance of this EULA, Apple will have the right, and will be deemed to have accepted the right, to enforce this EULA against you as a third-party beneficiary.
25. EXPORT CONTROLS, SANCTIONS, AND LEGAL COMPLIANCE
You may not use, export, re-export, release, or transfer the Licensed Application except as authorized by United States law and the law of the jurisdiction in which the Licensed Application was obtained.
Without limitation, the Licensed Application may not be exported or re-exported to a destination or person prohibited by applicable United States export controls or sanctions.
You may not use GoMaybe for a purpose prohibited by United States law.
You are responsible for complying with laws applicable to your use of GoMaybe, including applicable laws governing ticketing, fraud, intellectual property, privacy, computer access, cybersecurity, and sanctions.
26. U.S. GOVERNMENT END USERS
To the extent applicable federal procurement law permits, the Licensed Application and documentation are provided to United States Government end users as commercial computer software and commercial computer software documentation with the same license rights provided to other end users under this EULA. Mandatory procurement law controls any conflict. This provision does not grant broader rights in Company source code or nonpublic technology.
27. GENERAL TERMS
27.1 Changes to this EULA
Company may update this EULA prospectively.
Material changes will be clearly presented before they take effect. Company will obtain renewed affirmative acceptance where required by applicable law. This EULA does not authorize undisclosed expansion of data collection or external processing.
Accepted versions and related evidence will be handled consistently with Section 1 and the Privacy Policy.
Changes will not apply retroactively to claims that accrued before the change, absent a separate agreement made after the dispute arose. A valid arbitration opt-out remains effective unless you later expressly agree otherwise. If a new or materially revised arbitration agreement is presented for acceptance, you will have 30 days after that acceptance to opt out through Section 22.10.
27.2 Assignment
You may not assign or transfer this EULA or your rights under it without Company's prior written consent except where applicable law provides a nonwaivable right to do so.
Company may assign this EULA in connection with a merger, corporate reorganization, financing, sale of equity, sale of assets, change of control, restructuring, or transfer of the GoMaybe business, subject to applicable law.
27.3 Severability and Reformation
Except as specifically provided in Section 22, if a provision of this EULA is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect.
Where permitted by applicable law, a court may reform an invalid or unenforceable provision only to the minimum extent necessary to make it enforceable.
27.4 No Waiver
Company's delay or failure to enforce a provision does not waive the provision or Company's right to enforce it later.
A waiver must be in writing and applies only to the specific circumstance for which it is given.
27.5 Entire Agreement; Order of Terms
This EULA, together with product-specific, feature-specific, promotional, subscription, or purchase terms affirmatively presented for a particular feature or transaction, constitutes the agreement between you and Company concerning the Licensed Application and supersedes prior agreements on that subject.
If specific purchase or feature terms conflict with this EULA, those specific terms control for the applicable transaction to the extent of the conflict. They cannot reduce mandatory Company responsibilities or Apple's protected rights under Section 24, or a nonwaivable right under applicable law.
Company's Privacy Policy separately governs Company's handling of personal information as described in Section 14.
27.6 No Agency, Partnership, or Fiduciary Relationship
This EULA does not create an employment, partnership, joint venture, franchise, fiduciary, brokerage, or agency relationship between you and Company.
Company is not your agent, ticket broker, fiduciary, custodian, or representative for ticket purchases or Event attendance merely because you use GoMaybe.
27.7 Electronic Communications and Notices
To the extent permitted by applicable law, you consent to receiving agreements, notices, disclosures, service communications, and other legally permitted communications electronically, including through the Licensed Application or an email address you separately provide. No online GoMaybe account is required, and a notice requiring individual delivery must use a legally sufficient method actually available for you.
You may retain electronic copies for your records.
Where applicable law requires a particular notice method or separate consent, Company will use the required method.
Marketing communications, if any, remain subject to applicable consent and opt-out requirements.
27.8 Headings and Interpretation
Headings are for convenience only and do not limit interpretation.
Unless context requires otherwise, words such as "including" and "includes" mean "including without limitation."
27.9 Nonwaivable Rights Control
Nothing in this EULA is intended to eliminate, waive, disclaim, restrict, or reduce a right, remedy, warranty, duty, or liability that applicable law does not permit the parties to eliminate, waive, disclaim, restrict, or reduce.
If this EULA conflicts with such a mandatory legal rule, the mandatory rule controls only to the extent of the conflict.
27.10 Survival
Provisions that expressly or by their nature are intended to survive termination or expiration of this EULA will survive, including applicable provisions concerning:
ownership; Company Technology; license restrictions; User Content ownership; Feedback; accrued payment obligations; warranty disclaimers; limitations of liability; indemnification; dispute resolution; governing law; Apple third-party-beneficiary rights; these General Terms.
27.11 Third-Party Beneficiaries
Except for:
(a) Apple and Apple's subsidiaries as expressly provided in Section 24.10; and
(b) Company Parties to the extent this EULA expressly grants them a protection, defense, limitation, indemnity, or other enforceable benefit,
this EULA does not create third-party-beneficiary rights in another person or entity.
Assignment of this EULA does not itself expand permission to access, collect, transfer or use your personal information. Applicable privacy obligations and required notices or consents continue to apply.
